1. Acceptance of Terms

By accessing and using the Explainables platform (the "Service"), available at tryexplainables.com, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you may not use the Service.

2. Description of Service

Explainables is an AI-powered educational platform designed to provide tutoring and learning support for CBSE students in classes 6 through 10. The platform offers:

• Free Tier: Basic access to AI tutoring, core educational features, and limited explanations
• VIP Subscription: Premium access with enhanced features, priority support, and unlimited explanations
• Brain Power Currency: In-platform currency for purchasing additional features, premium questions, and personalized study materials

The Service is provided on an "as-is" basis. We reserve the right to modify, suspend, or discontinue any feature of the Service at any time without notice.

3. User Accounts

Account Requirements

• You may create one account per person. Multiple accounts are prohibited
• You must be at least 11 years old to use the Service
• If you are under 18 years old, a parent or legal guardian must provide consent for your use of the Service
• You are responsible for maintaining the confidentiality of your login credentials (username and password)
• You are responsible for all activities conducted under your account

Accurate Information

You agree to provide accurate, complete, and current information during account registration and to update this information as needed. Providing false or misleading information may result in account suspension or termination.

4. Subscription & Payments

VIP Subscription Plans

• VIP subscriptions are billed on a recurring basis (monthly or annually, as selected)
• Auto-renewal is enabled by default. You will be charged on your renewal date
• You can cancel your subscription anytime from your account Settings. Cancellation takes effect at the end of your current billing cycle
• Upon cancellation, you lose access to VIP features immediately

Brain Power Packs

• Brain Power packs are one-time purchases and are non-renewable
• Brain Power credits do not expire and remain valid indefinitely
• Once used, Brain Power cannot be refunded

Payment Processing

All payments are processed securely through Razorpay and PayPal, third-party payment providers. By making a payment, you agree to be bound by Razorpay's Terms of Service and PayPal's User Agreement. Explainables is not responsible for payment processing errors or issues arising from Razorpay's or PayPal's services.

Refund Policy

• VIP Subscriptions: You may request a refund within 7 days of purchase. After 7 days, refunds are not available.
• Brain Power Packs: No refunds once purchased and credited to your account

5. Acceptable Use

You agree not to use the Explainables platform for any prohibited activities, including but not limited to:

• Academic Dishonesty: Using the Service to cheat on exams, tests, or assignments, or submitting AI-generated responses as your own work without acknowledgment
• Unauthorized Scraping: Automated scraping, crawling, or downloading of platform content, summaries, or data without permission
• Account Sharing: Sharing your account credentials with others or allowing others to use your account
• Reverse Engineering: Attempting to reverse engineer, decompile, or discover the underlying algorithms or source code of our AI systems
• Abusive Content: Posting, sending, or using abusive, offensive, hateful, discriminatory, or inappropriate language in chat or messages
• Harassment: Harassing, threatening, or bullying other users or staff members
• Illegal Activities: Using the Service for any illegal purposes or in violation of local, state, or national laws
• Unauthorized Access: Attempting to gain unauthorized access to protected accounts, systems, or data

Violation of these terms may result in immediate suspension or permanent termination of your account, without refund.

6. AI-Generated Content Disclaimer

Explainables uses artificial intelligence to generate explanations, summaries, and educational content. Please be aware of the following:

• Educational Purpose Only: AI-generated responses are intended for educational support and learning purposes only, not as professional advice
• Potential Errors: While our AI is trained to be accurate, it may occasionally generate incorrect information, incomplete explanations, or misinterpretations of concepts
• Verification Required: Always verify AI responses with your textbooks, teachers, or official CBSE resources before relying on them for study or exams
• No Liability: Explainables is not responsible for any errors, inaccuracies, or adverse outcomes resulting from reliance on AI-generated content
• Not a Substitute: This Service is a supplementary learning tool and does not replace structured classroom education or professional tutoring
• We Do Not Comply Unconditionally: We do not guarantee that AI-generated answers are 100% accurate or complete. We actively review and improve AI responses but disclaim liability for any incorrect content generated by the AI model

7. Third-Party AI Services

Explainables uses AI models provided via API from a third-party AI service provider. By using this Service, you acknowledge and agree to the following:

• User Input Processing: Your questions, chat messages, and educational queries are sent to a third-party AI provider for processing to generate responses. This is a core part of how the Service works
• Third-Party Privacy Policy: The AI provider processes your input in accordance with their own privacy policy. We encourage you to review the relevant provider's privacy policy (linked in our Privacy Policy)
• Data Retention: Explainables does not permanently store your chat content on its servers beyond what is necessary for session continuity. However, the third-party AI provider may retain inputs per their own data retention policies
• No Sensitive Data: Do not share personally identifiable information, financial details, passwords, or sensitive personal data in your questions. The Service is intended for educational queries only
• Trained Context: The AI has been configured with custom prompts, NCERT curriculum context, and personality guidelines by Explainables. Despite this training, the AI remains a third-party model and its outputs are not guaranteed to be accurate

8. Intellectual Property

Explainables Content: All original content created by Explainables, including but not limited to the platform interface, branding, logos, design, summaries, explanations, and educational materials created by our AI and human team, are the exclusive intellectual property of Explainables. You may not reproduce, distribute, modify, or use this content without explicit written permission.

NCERT & Government Content: Content derived from NCERT textbooks and materials is the property of the National Council of Educational Research and Training (NCERT) and the Government of India. Explainables provides this content in accordance with applicable laws.

User Content: You retain ownership of any content you create or submit through the Service. By submitting content, you grant Explainables a non-exclusive, royalty-free license to use, display, and improve that content for platform enhancement and moderation purposes.

9. Limitation of Liability

To the fullest extent permitted by Indian law, Explainables shall not be liable for:

• Learning outcomes, academic performance, or exam results
• Technical issues, downtime, system failures, or data loss
• Errors or inaccuracies in AI-generated content
• Loss of access to the Service or interruptions
• Any indirect, incidental, or consequential damages arising from use of the Service

Our total liability for any claim arising from or related to this Service shall not exceed the amount you have paid to Explainables in the past 12 months.

10. Termination

Termination by Explainables

Explainables reserves the right to suspend or terminate your account immediately if:

• You violate any provision of these Terms & Conditions
• You engage in abusive, harassing, or illegal behavior
• You attempt to compromise platform security or integrity
• We determine that your use of the Service poses a risk to other users or the platform

Upon termination, your access to the Service will be revoked immediately. No refunds will be provided except as required by our Refund Policy.

Termination by You

You may delete your account and terminate your relationship with Explainables at any time by accessing the Account Settings page and selecting "Delete Account". Please note that account deletion is permanent and cannot be reversed. All your data will be removed from our systems.

11. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree that any legal action or proceeding relating to this Service shall be brought exclusively in the courts of India, and you consent to the jurisdiction and venue of such courts.

12. Changes to Terms

Explainables reserves the right to modify these Terms & Conditions at any time. Material changes will be notified to you via email at least 14 days before the changes take effect. Your continued use of the Service after the notification period constitutes acceptance of the updated terms.
